PASSENGER TICKET 
THIS AGREEMENT is made and entered into on the date of ticket purchase by and between MANANA, a company duly registered under the laws of France, hereinafter referred to as the 'MANANA,' and the individual purchasing the ticket, hereinafter referred to as the 'Passenger.'
1. DEFINITIONS 
1.1 'MANANA ' refers to MANANA'S employees, agents, and representatives. 
1.2 'Passenger' refers to the ticket purchaser and/or the individual utilising the ticket for access to the vessel. 
1.3 'Vessel' refers to the boat hosting the event and providing food and beverage services. 
1.4 'Event' refers to the onboard experience, including unlimited food and beverage service, offered by the MANANA.
2. TICKET PURCHASE AND VALIDITY 
2.1 The ticket grants the Passenger access to the Vessel for the specific date and time stated on the ticket. 
2.2 Tickets are non-transferable and non-refundable unless explicitly stated otherwise by the MANANA. 
2.3 The MANANA reserves the right to refuse ticket sales to any individual at its sole discretion.
3. SERVICES INCLUDED 
3.1 The ticket includes unlimited food and beverage service as provided by the MANANA during the Event. 
3.2 The MANANA reserves the right to determine the selection and availability of food and beverages. 
3.3 No additional services outside the included package will be available for purchase onboard.
4. PASSENGER RESPONSIBILITIES 
4.1 The Passenger must comply with all safety instructions provided by the crew and posted onboard. 
4.2 The Passenger is responsible for their personal belongings, and the MANANA assumes no liability for lost or stolen items.
 4.3 The Passenger must respect all crew members, fellow passengers, and the property of the Vessel.
5. FOOD AND BEVERAGE CONSUMPTION 
5.1 Alcoholic beverages will only be served to Passengers aged 18 and above. Proof of age may be required. 
5.2 Passengers are not permitted to bring external food or beverages onboard unless pre-approved by the MANANA. 
5.3 MANANA reserves the right to refuse service to any Passenger appearing intoxicated or behaving in a disruptive manner. 
5.4 Excessive consumption of alcohol that leads to disorderly conduct will result in removal from the Vessel without a refund.
6. SAFETY AND CONDUCT 
6.1 The Passenger must comply with all maritime safety regulations and the instructions of the Vessel's crew. 
6.2 Any misconduct, including vandalism, harassment, or violence, will lead to immediate removal from the Vessel without a refund. 
6.3 In the event of an emergency, the Passenger must follow all safety protocols, including the use of life-saving equipment.
7. LIABILITY AND FORCE MAJEURE 
7.1 MANANA shall not be liable for any personal injury, loss, damage, or expense incurred by the Passenger unless caused by gross negligence. 
7.2 MANANA is not responsible for changes or cancellations due to force majeure events, including but not limited to extreme weather, governmental regulations, mechanical failure, or acts of God. 
7.3 MANANA reserves the right to modify or cancel the Event for safety reasons without liability beyond a refund or rescheduling option.
8. GOVERNING LAW AND JURISDICTION 
8.1 This contract shall be governed by and construed in accordance with the laws of the Principality of Monaco. 
8.2 Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Monaco.
9. ACCEPTANCE OF TERMS 
9.1 By purchasing a ticket and/or boarding the Vessel, the Passenger acknowledges and agrees to the terms and conditions set forth in this Agreement.

9. ACCEPTANCE OF TERMS  
9.1 By purchasing a ticket and/or boarding the Vessel, the Passenger acknowledges and agrees to the terms and conditions set forth in this Agreement.

1) Important : By purchasing a ticket the passenger accepts all legal conditions of the General Terms of Transportation mentioned below.

 

2) Passengers' state of health- Pregnant women - Passengers with reduced mobility:

a- Health condition of passengers: Any particular state of health have to be notified at the reservation. In case of non-declaration at the reservation, the Captain may refuse boarding to passengers whose state of health is not compatible with the excursion without any refund or compensation of any kind can be claimed by the passenger.

The Captain has full authority to refuse boarding to anyone who has a physical or mental state including any condition caused by the consumption of alcohol or the use of drugs or medication, that could present a hazard or risk to himself, other Passengers, the crew or property.

In all the cases listed above, the passenger will be responsible for damage to himself, the ship, property and equipment, others passengers and others passengers property. The acceptance of the passenger on board by the Company does not deny his right to assert his reservations on the condition of the passenger, known or not by the carrier, at the time of boarding and / or when leaving the ship.

b- Pregnant women: Pregnant women are required to report their condition on booking. In case of non-declaration at the reservation, the Captain may refuse boarding to pregnant women without any refund or compensation of any kind can be claimed by the passenger. The Captain has full authority to refuse boarding according to the month of pregnancy and the weather forecast. The acceptance of the passenger on board by the Company does not deny his right to assert his reservations on the condition of the passenger, known or not by the carrier, at the time of boarding and / or when leaving the ship.

c- Passengers with reduced mobility: Passengers with reduced mobility are required to report their condition on booking. In case of non-declaration at the reservation, the Captain may refuse boarding to passengers whose disability is not compatible with the excursion without any refund or compensation of any kind can be claimed by the passenger.

 

3) Minor children: Unaccompanied children under 16 can not travel alone. They will be constantly under the care of parents or other accompanying person who is responsible, and can not travel in the ship unaccompanied. In any case the Company will not be held responsible for damage to minors in violation of what is stated above.

 

4) Animals: No pets are allowed aboard our semi-rigid boat, Le Bateau 2 (12 places). Only under-20kg-dogs are accepted aboard our passenger boat, Le Bateau 1 and only if they have been registered at the reservation. The Captain may refuse boarding to any passenger accompanied by an unregistered dog or a dog exceeding the authorized weight  without any refund or compensation of any kind can be claimed by the passenger.

 

5) Cancellation of departure and refund:

a-Individual price: In case of cancellation of the departure by the Company, the ticket is fully reimbursed. It can not be asked for compensation of any kind by the customer.

In case of cancellation by the customer the ticket is neither modifiable nor refundable in the last 24 hours before the departure.

b- Group rate: In case of cancellation of the departure by the Company, the ticket is fully reimbursed. It can not be asked for compensation of any kind by the customer.

In case of cancellation by the customer the ticket is neither modifiable nor refundable in the last 4 days before the departure.

 

6) Modification of the excursion

The Company reserves the right, at the discretion of the Captain and for reasons inherent to navigation, to make stops other than those planned or to modify the initial route.

It is permissible for the Captain to tow, to assist ships in all situations, to divert, to make all rescues and transhipments.

Neither the Captain nor the Company shall be responsible for any diversions, alterations, interruptions of services or delays in ship departures and arrivals, or for non-coincidence in ship arrivals, departures or connections, and planes and trains.

 

7) Stopovers

Neither the Captain nor the Company can be held responsible in case of no-show of the passenger at the boarding of return at the stopovers. The costs of return caused by the non-presentation of the passenger remain entirely his responsibility. It can not be asked for reimbursement or compensation of any kind by the passenger.
